Staten Island University Hospital Pays $25 Million To Settle;
Whistleblower-Client Receives Approximately $3.75 Million
Lifflander & Reich name partner Richard I. Reich, a veteran litigator with years of trial experience, is known for his painstaking investigation and trial preparation. In 2004, Reich broke new ground after thoroughly investigating allegations against Staten Island University Hospital and the physician who treated the firm's client.
In addition to the malpractice case that brought his client to Lifflander & Reich, Reich filed a second separate parallel qui tam whistleblower complaint in federal court on behalf of his client, a widow whose husband died after receiving cancer treatment. The client and Reich discovered that the hospital had billed Medicare for services then not covered by the federal health insurance program. The whistleblower suit named the hospital and the physician.
In September 2008, Staten Island University Hospital settled the whistleblower's allegations. Our client, the relator, was awarded approximately $3.75 million for bringing allegations that Reich developed that returned $25 million in alleged health care fraud back to taxpayers.
The remaining qui tam whistleblower allegations against the physician have not yet been resolved by the federal government.
