In one of the largest civil fraud recoveries ever against a single U.S. hospital, the federal government will receive $74 million and New York State will receive $14.9 million.

STATEN ISLAND, N.Y. -- Staten Island University Hospital has agreed to pay $88.9 million to settle government claims that it overbilled and improperly charged Medicaid, Medicare and TRICARE, the military's health insurance program and also treated patients in non-certified beds, officials said yesterday.

The settlement is among the largest for a health-care fraud case against a single hospital in U.S. history and comes with University Hospital already paying back $121.5 million for prior Medicaid fraud. The deal was announced, ironically, yesterday morning as hospital officials and benefactors were attending a charity outing to benefit University Hospital.

Sept. 15 (Bloomberg) -- The U.S. and New York will get almost $89 million from Staten Island University Hospital in New York City to settle claims it defrauded Medicare, Medicaid and the military's health insurance program.

The hospital agreed to pay the U.S. $74 million and New York almost $15 million, according to statements today by U.S. Attorney Benton Campbell in Brooklyn, New York, and state Attorney General Andrew Cuomo.

Staten Island University Hospital agreed to pay almost $89 million to federal and state authorities for fraudulently billing Medicare, Medicaid and TRICARE, the insurance offered to military personnel, officials said yesterday.

It is one of the largest health-care fraud settlements from a single hospital, said a spokesman for the Brooklyn US Attorney's Office, which investigated the case.

The settlements stem from two False Claims Act suits filed by whistleblowers, as well as two investigations by the US Attorney's Office and the state Attorney General's Office. The fraud schemes date between 1994 and 2005, officials said.

In a massive settlement involving the treatment of thousands of patients from the New York City area, Staten Island University Hospital has agreed to fork over nearly $89 million to the federal and state governments to clear up allegations it defrauded health care programs.

The settlement, believed to be the biggest for one hospital, came in a lawsuit filed in federal court in Brooklyn by the federal government claiming that the hospital ripped off the Medicare, Medicaid and military health insurance program through years of false billing practices.

"The settlements are related to three separate investigations, two of them instigated by whistle-blower suits.

In the most costly, the hospital will pay the federal government $25 million to settle charges that from 1996 through 2004, it fraudulently billed Medicare and the military insurance plan TRICARE for a controversial cancer treatment called stereotactic body radiosurgery, one that is not covered by the government plans.

The widow of a cancer patient brought the suit, and will get $3.75 million as her portion of the recovery.

Staten Island University Hospital has agreed to pay the U.S. Department of Justice and the state of New York nearly $89 million to settle a handful of False Claims Act allegations brought by both the feds and private whistleblowers. The hospital, which admitted no wrongdoing, said in a written statement that it had already put programs into place to address the problems addressed by these allegations when the investigation began.

One whistleblower suit charges that the hospital defrauded Medicare and Tricare by consciously using the wrong billing codes for stereotactic radiosurgery from 1996 to 2004 in care for her now-deceased husband. To settle this charge, the hospital will pay $25 million to the federal government, of which the widow, …, will get $3.75 million.
